We establish Alternative Dispute Resolution (ADR) programs that dramatically improve the delivery of workers’ compensation benefits for people injured on the job. Every claim is processed in accordance with permissive labor code statutes while reducing costs associated with construction site injuries by as much as 40%.
Injured workers who participate in the program generally discover additional benefits such as faster claims resolution, better access to medical care, and avoidance of a lengthy litigation process. Our ADR process does not withhold any rights specified by the state.
ADMIN
With 100 years of workers’ compensation experience, and four generations now leading the charge, we’re exceptionally equipped to draft ADR contracts and create an effective medical panel and claims adjudication process. We rely on highly respected physicians who treat injured workers, not “litigation doctors” who churn out cases for the benefit of claimants.
Set Up
We design ADR programs that are virtually turnkey. Our attorneys use their expertise to negotiate all labor contracts with the goal of providing a fair and successful system for all participants. With a 100% approval rating, all programs are approved by the New York State Workers’ Compensation Board.
Consulting
Our clients are assigned a personal DFS-licensed claims consultant with 35 years of workers’ compensation experience who will educate all parties and provide guidance from start to finish. With attorney oversight, we handle all workers’ compensation disputes and negotiate with labor’s chosen ombudsperson to resolve claims quickly and fairly.
MRM CORE COMPONENTS
Draft ADR Agreement
For every client, we develop a working, collectively bargained ADR agreement that satisfies requirements of the employer, labor union, and Workers’ Compensation Board.
SECURE ADR APPROVAL
MRM will marshal each agreement through the Workers’ Compensation Board to ensure its approval and sign-off.
COMMENCE TRAINING
We will take the lead when a program requires contractors, carriers, and third-party administrators to be trained on the intricacies of ADR, which must be incorporated into the existing structure of each client’s insurance program.
Partnership with Labor
Our team will hold joint labor management meetings to discuss safety initiatives and upcoming construction efforts, ensuring clear lines of communication between the employer, labor union, and oversight committee.
ENHANCE SAFETY
An MRM representative will participate in pre-construction meetings to help effectuate a safe working environment with management and labor at the same table.
Triage Injuries
MRM will establish a program to triage injuries and help determine appropriate medical care to mitigate client losses and ensure the best treatment for injured workers. We’ll work closely with your claims department to facilitate a fast yet comprehensive investigation of each claim
OVERSEE RETURN TO WORK
We’ll collaborate with the labor union and employer to help get injured workers back to work safely at full pay rather than reduced workers’ compensation benefits.
REVIEW CLAIMS
MRM will work with the client, carrier, and defense counsel to ensure that all claim reviews are timely, organized, and effective. We will also assist your claims adjuster with all filings and adjusting decisions.
PROVIDE UPDATES
We work with carriers to provide client updates on program performance. We will furnish benchmark reports, comparisons of actual v. estimated loss, updated loss ratios, and estimated savings in an easy-to-read format.
